1. Acceptance of Terms

By accessing or using the Muslim Business Directory platform at muslimbusiness.ai ("the Platform"), operated by Werkx ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

2. Description of Service

The Platform is an AI-powered business discovery directory for Muslim-owned businesses in Australia. It provides:

• A searchable directory of Muslim-owned businesses across Australia
• An AI voice search agent ("David") for voice-powered business discovery
• The ability for business owners to claim, add, and manage their business listings
• Waitlist registration for upcoming features (Network & Refer, Ummah Tasks)

3. User Accounts & Verification

Certain features of the Platform require phone verification via OTP (one-time password). By verifying your phone number, you:

• Confirm that the phone number belongs to you or that you are authorised to use it
• Agree to receive transactional SMS messages (OTP codes) from us
• Accept responsibility for all activity under your verified account

You must provide accurate and complete information. We reserve the right to suspend or terminate accounts that provide false information.

4. Business Listing Data

4.1 Publicly Available Information

The Platform aggregates business information from publicly available sources on the internet, including other business directories and public websites. This information includes business names, addresses, phone numbers, operating hours, and service descriptions.

4.2 No Guarantee of Accuracy

While we take reasonable steps to ensure listing data is accurate and up-to-date, we make no warranty or guarantee as to the accuracy, completeness, or currency of any business listing information on the Platform. Information sourced from third-party public sources may be outdated, incorrect, or incomplete.

4.3 Business Owner Rights

Business owners may claim their listing to verify and update their information. If you are a business owner and wish to correct or remove your listing, please contact us at contact@muslimbusiness.ai or use the "Claim Your Business" feature on the Platform.

4.4 User-Submitted Content

When you submit business information, reviews, or other content to the Platform, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content in connection with the operation of the Platform. You represent that you have the right to submit such content and that it does not infringe any third-party rights.

5. Prohibited Uses

You must not use the Platform to:

• Submit false, misleading, or fraudulent business information
• Impersonate another person or business, or falsely claim ownership of a business
• Scrape, harvest, or systematically extract data from the Platform using automated means without our written consent
• Use the Platform for any unlawful purpose or in violation of any applicable law
• Interfere with or disrupt the Platform's infrastructure, security, or other users' access
• Send unsolicited commercial communications (spam) through or using the Platform
• Attempt to reverse engineer, decompile, or disassemble any part of the Platform

We reserve the right to remove content and suspend or terminate accounts that violate these prohibitions.

6. AI Voice Agent

The Platform's voice search feature ("David") is an AI-powered system, not a human operator. By using the voice agent, you acknowledge that:

• Responses are generated by artificial intelligence and may contain inaccuracies
• The voice agent's recommendations are for informational purposes only and do not constitute professional advice
• Voice interactions are processed by third-party AI services (see our Privacy Policy)
• We are not liable for any decisions made based on the voice agent's responses

7. No Endorsement of Listed Businesses

The Platform does not endorse, verify, recommend, or guarantee any business listed in the directory. Listings are provided for informational purposes only. Any interaction, transaction, or dispute between you and a business listed on the Platform is entirely at your own risk. We are not a party to any agreement between you and any listed business.

8. Anti-Scraping & Data Extraction

You are prohibited from using bots, scrapers, crawlers, spiders, or any automated process to extract, harvest, or collect data from the Platform without our prior written consent. You may not compile listing data from the Platform into a competing product or service. We actively monitor for unauthorised data extraction and reserve the right to take legal action against violations.

9. Content Moderation

We reserve the right (but have no obligation) to review, edit, remove, or decline any listing, review, or content at our sole discretion and without prior notice. This includes content that we determine violates these Terms, is inaccurate, is inappropriate, or may expose us or our users to harm or liability.

10. Intellectual Property

The Platform, including its design, features, code, branding, and AI technology, is owned by Werkx and protected by Australian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our written consent.

Business listing data sourced from publicly available sources remains factual information and is not claimed as our intellectual property. However, the compiled database, its organisation, and the Platform's presentation of that data are protected.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing, we do not warrant that:

• Business listing information is accurate, complete, or current
• The Platform will be uninterrupted, error-free, or secure
• The AI voice agent will provide accurate or reliable responses
• Any business listed on the Platform meets any particular standard of quality or service

12. Limitation of Liability

To the maximum extent permitted by law, Werkx shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to:

• Reliance on business listing information that is inaccurate or outdated
• Any transaction, interaction, or dispute between you and a business listed on the Platform
• Loss of data, revenue, or business opportunity
• Actions taken based on AI voice agent responses

Our aggregate liability to you for all claims arising from your use of the Platform shall not exceed the greater of AUD $1.00 or the total amounts you have paid to us in the one (1) month period preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).

13. Indemnification

You agree to indemnify, defend, and hold harmless Werkx, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Content you submit to the Platform
• Your violation of any applicable law or third-party rights

14. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause or notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales for any disputes arising from these Terms or your use of the Platform.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
